1. Agreement to Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you and The Website Forgery ("we", "us", or "our") regarding your use of our website thewebsiteforgery.com and our web design and development services.

By accessing our website or engaging our services, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not use our services.

2. Services

2.1 Scope of Services

We provide web design, development, and related services as described on our website. Specific services will be outlined in individual project proposals or contracts.

2.2 Project Proposals

All projects begin with a discovery call and written proposal that includes:

  • Project scope and deliverables
  • Timeline and milestones
  • Fixed price quote
  • Payment terms
  • Revision policy

3. Client Responsibilities

To ensure timely project completion, you agree to:

  • Provide accurate and complete information
  • Supply required content, images, and materials within agreed timeframes
  • Provide timely feedback on deliverables
  • Ensure you have rights to all materials you provide
  • Make timely payments as agreed
  • Respond to communications within 48 hours during active projects

Delays caused by failure to meet these responsibilities may result in project timeline extensions and potential additional charges.

4. Payment Terms

4.1 Pricing

All prices are quoted in British Pounds (£) and are fixed for the agreed scope of work. Additional work outside the agreed scope will be quoted separately.

4.2 Payment Schedule

Unless otherwise agreed in writing:

  • Deposit: 50% upfront before work begins
  • Final Payment: 50% due upon project completion, before handover

4.3 Late Payments

Invoices are due within 7 days of issue. Late payments may incur interest at the rate of 8% per annum above the Bank of England base rate (as permitted under the Late Payment of Commercial Debts Act 1998).

4.4 Refunds

Deposits are non-refundable once work has commenced. If you cancel after work has begun, you will be charged for work completed to date.

5. Intellectual Property Rights

5.1 Ownership Transfer

Upon receipt of full payment, you own:

  • The final website design and code we create specifically for you
  • All custom graphics and content we create
  • Full rights to use, modify, and distribute your website

5.2 Retained Rights

We retain rights to:

  • Display the work in our portfolio
  • Use the project as a case study
  • Reuse techniques, methodologies, and code snippets in future projects

5.3 Third-Party Materials

Some elements (stock photos, fonts, plugins, frameworks) may be licensed from third parties and subject to their respective licenses. You are responsible for maintaining any required subscriptions or licenses.

6. Revisions and Changes

6.1 Included Revisions

Each project includes a specified number of revision rounds as outlined in the proposal. Revisions must be requested within the revision period.

6.2 Additional Revisions

Changes beyond the agreed scope or revision rounds will be quoted separately and billed at our hourly rate or as a fixed fee.

6.3 Scope Creep

Significant changes to project scope may require a revised proposal, timeline, and pricing. We'll communicate this promptly if it occurs.

7. Warranties and Disclaimers

7.1 Our Warranties

We warrant that:

  • Services will be performed with reasonable skill and care
  • Websites will be functional and meet agreed specifications at launch
  • We hold appropriate licenses for any third-party materials we provide

7.2 Post-Launch Support

We provide 30 days of free post-launch support to fix any bugs or technical issues that arise from our work. This does not include:

  • Changes to content or design
  • Issues caused by third-party services or hosting
  • Problems arising from your modifications
  • Training or consultation beyond initial handover

7.3 Disclaimer

Except as expressly stated, we provide services "as is" without warranties of any kind. We do not guarantee specific results, search engine rankings, or business outcomes.

8. Limitation of Liability

To the fullest extent permitted by law:

  • Our total liability shall not exceed the total fees paid by you for the specific project
  • We are not liable for indirect, consequential, or incidental damages including lost profits, business interruption, or data loss
  • We are not liable for issues caused by third-party services, hosting providers, or your own actions

Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded by law.

9. Termination

9.1 Termination by Client

You may terminate a project at any time by providing written notice. You will be charged for:

  • All work completed to the date of termination
  • Any non-refundable expenses incurred
  • The deposit (if work has commenced)

9.2 Termination by Us

We may terminate a project if:

  • You fail to make required payments
  • You breach these Terms
  • You fail to provide required materials or feedback for 30+ days
  • The working relationship becomes untenable

10. Confidentiality

We will keep confidential any proprietary or sensitive information you share with us, except:

  • Information that is publicly available
  • Information we must disclose by law
  • Information necessary to complete the project (shared only with relevant service providers)

11. Force Majeure

We are not liable for delays or failures caused by circumstances beyond our reasonable control, including natural disasters, acts of government, power failures, internet outages, or pandemics.

12. General Provisions

12.1 Governing Law

These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.

12.2 Entire Agreement

These Terms, together with any project proposal or contract, constitute the entire agreement between you and us.

12.3 Amendments

We may update these Terms at any time. Changes apply to projects initiated after the update. We'll notify you of significant changes.

12.4 Severability

If any provision is found unenforceable, the remaining provisions remain in full effect.
